In order to keep Up the Ranks Performance LLC. operating and serving to the highest standards, it is essential that our policies are carefully reviewed and upheld. We take pride in delivering high quality instruction, fostering positive communication, supporting skill development, building strong player relationships, and pushing our athletes to reach their highest potential , which remains our top priority. We sincerely appreciate your continued support of our business and coaching staff.

Cancellation Agreement

Up the Ranks Performance LLC. requires all training sessions to be cancelled AT LEAST 24 hours in advance.

Failure to cancel a scheduled appointment within the 24 hour window will result in cancellation fee's that can be found below. These penalty charges will be automatically added onto the total owed next appointment. NO EXCEPTIONS!

We understand that under some circumstances your child may not be able to attend a training session due to a medical emergency. In the event of a cancellation for any illness or injury, a doctor’s note is REQUIRED to avoid a cancellation charge.

PLEASE REMEMBER - Our Cancellation Policy/Agreement is created and enforced in order to protect our small business. So while this may seem strict, as instructors our personal time is our livelihood.

All clients agree to these terms and conditions before scheduling a training session. Unwillingness to comply means you will no longer be able to train or participate with Up the Ranks Performance LLC.

Late Arrivals: If a client is more than 15 minutes late for a session, the session will be considered cancelled and the client will be charged in full.

Injury Liability Waiver and Release of Claims

This Liability Waiver and Release of Claims (“Waiver”) is executed by the undersigned participant (“Participant”) in favor of Up the Ranks Performance LLC (“Company”), its owners, officers, directors, employees, agents, coaches, staff, volunteers, and other representatives (collectively referred to as the “Released Parties”). By signing this Waiver, the Participant acknowledges and agrees to the following terms:

Acknowledgment of Risks: Participant understands and acknowledges that participation in baseball training activities, including but not limited to batting, pitching, fielding, catching, speed and agility work, strength and conditioning exercises, and other related activities (collectively referred to as the “Training Activities”) involves inherent risks. These risks include, but are not limited to, physical injury, sprains, strains, fractures, concussions, dislocations, or even death, whether caused by the Participant’s own actions, the actions of others, or the conditions of the training environment.

Assumption of Risk: Participant voluntarily assumes all risks associated with the Training Activities. This includes the risk of injury, illness, or death, whether caused by the Participant’s own actions, the actions of other participants, the conduct of coaches or trainers, or any conditions inherent to the Training Activities. Participant further acknowledges that injuries may occur despite the precautions taken by the Company and its personnel.

Release of Liability: To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and agrees not to sue the Released Parties for any and all claims, demands, actions, or causes of action arising from or related to any injury, loss, damage, or death resulting from the Participant’s participation in the Training Activities, whether such injury is caused by the negligence of the Released Parties or otherwise.

Indemnification: Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, liabilities, or expenses (including reasonable attorney’s fees) arising out of or related to the Participant’s actions or failure to follow safety guidelines, instructions, or training protocols during the Training Activities.

Medical Authorization: In the event of an emergency or injury, Participant authorizes the Company to obtain emergency medical treatment on their behalf, including transportation to a medical facility if necessary. Participant agrees to bear all costs associated with such medical treatment and transportation.

Health and Fitness Declaration: Participant affirms that they are in good health and have no physical condition, injury, or medical condition that would prevent their safe participation in the Training Activities. If the Participant has any medical conditions or concerns that may affect their participation, they agree to inform the Company and its coaches before beginning the Training Activities.

Compliance with Rules and Instruction: Participant agrees to follow all safety guidelines, rules, and instructions provided by the Company, its coaches, and staff, and to use the equipment and facilities in a safe manner. Participant understands that failure to follow these instructions may increase the risk of injury.

Acknowledgment of Understanding: Participant acknowledges that they have carefully read and fully understand this Waiver. Participant further understands that by signing this Waiver, they are relinquishing certain legal rights, including the right to sue the Released Parties for injuries or damages related to participation in the Training Activities.

Photo Permission and Usage Release

I authorize Up the Ranks Performance LLC. the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken to be used in and/or for legally promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats and markets now known or hereafter devised.  

I understand and agree that these materials shall become property of Up the Ranks Performance LLC. and will not be returned.

I hereby hold harmless, and release Up the Ranks Performance LLC. from all liability and grant them permission to use these documents.

Formalities and Decorum

Athletes, spectators and guests are expected to set a superior example of sportsmanship and respect of others on the premises. Abusive behavior, sexual harassment, offensive language and physical violence of any kind will result in suspension of training with Up the Ranks Performance LLC. until further notice. Individuals in violation of conduct will be asked to leave immediately without refund and may be subject to legal actions from Ownership of Up the Ranks Performance LLC.

Any Injury or damage(s) must be reported to the duty manager or active instructor immediately. Please understand that you are personally responsible and financially held accountable for any damages done to the facility or training space.

Up the Ranks Performance LLC. does not assume responsibility and is not liable for any personal property or equipment that is lost, stolen or left behind.

Food and trash must be discarded in appropriate receptacles and not left on the sports performance area. Please understand Up the Ranks Performance LLC. leases training space from different locations and unsatisfactory cleaning efforts are a poor reflection on our company and its attending families.

No drugs, alcohol or chewing tobacco is permitted on or around the facility. This will result in automatic suspension.

Trainer Conduct and Professionalism

Professionalism
Our trainers are expected to maintain a professional appearance and consistently demonstrate respectful, courteous, and ethical behavior. We uphold a strict standard of conduct, and any form of inappropriate behavior toward clients is not tolerated.

Confidentiality
We are committed to protecting the privacy of our athletes. All client information—including personal data, medical history, and training progress—is kept strictly confidential and will only be shared with proper consent or when required by law.

Continual Education
Our trainers are dedicated to ongoing professional development. We encourage continued education through certifications, industry seminars, and staying current with evolving training methods to ensure we provide the highest level of coaching and performance training.

Accountability & Standards
Our trainers hold themselves and our athletes to a high standard of accountability. We emphasize punctuality, preparation, and consistent effort to ensure a productive and professional training environment.

Athlete Safety & Well-Being
The health and safety of our athletes is our top priority. We focus on proper technique, structured progression, and injury prevention to support long-term athletic development.

Weather and Emergency Closure Policy

In the event of severe weather or a mandated closure—when conditions pose a risk to the safety, health, or well-being of our athletes and staff—Up the Ranks Performance will make every reasonable effort to reschedule all affected training sessions.

Rescheduled sessions will be arranged based on availability. While we strive to maintain consistency, we cannot guarantee the availability of the original instructor.

We appreciate your understanding as we prioritize the safety of our athletes and staff at all times.

Events, Camps, and Clinics Policy

Schedule Changes
All schedules, dates, times, and locations are subject to change when necessary. Up the Ranks Performance reserves the right to make adjustments to ensure the quality and safety of all events, camps, and clinics.

Medical Disclosure
Participants (or their guardians) are responsible for notifying us of any relevant medical conditions at the time of registration and prior to participation in any training, competition, or physical activity. This information is essential to ensure a safe training environment.

Personal Arrangements
Any personal arrangements made in connection with an event, camp, or clinic—including travel, accommodations, or hospitality—are the sole responsibility of the participant. Up the Ranks Performance is not liable for any costs or losses related to these arrangements.

Policy Updates
We reserve the right to update or modify our terms and conditions at any time to reflect changes in laws, regulations, or improvements to our programs and services. Any updates will be communicated as appropriate.

Participation & Conduct
All participants are expected to demonstrate respectful behavior and follow the instruction of coaches and staff at all times. Up the Ranks Performance reserves the right to remove any participant whose behavior is deemed unsafe or disruptive.

COVID-19 Health & Safety Policy

General Notice
COVID-19 has been declared a worldwide pandemic and is recognized as a highly contagious virus. While we take reasonable precautions to promote a safe training environment, Up the Ranks Performance LLC cannot guarantee that exposure will not occur.

Face Coverings
Masks and facial coverings are not required for staff or participants. However, we encourage all individuals to make decisions they feel are appropriate for their personal health and safety.

Upon request, our trainers and staff will gladly wear a mask during sessions. We encourage open communication—please do not hesitate to ask.

Assumption of Risk
By participating in training sessions or entering the facility, you acknowledge and accept that there is an inherent risk of exposure to COVID-19. Participation in all training activities is done at your own risk.

You further acknowledge that Up the Ranks Performance LLC cannot prevent exposure to, contraction of, or transmission of COVID-19.

Release of Liability
By engaging in services provided by Up the Ranks Performance LLC, you agree to release and hold harmless the company, its owner, employees, and representatives from any claims related to exposure, illness, or transmission of COVID-19.

Health Disclosure
Participants (or their guardians) are responsible for informing staff of any relevant medical conditions, including respiratory issues (e.g., asthma) or other limitations that may impact training. This information is used solely for internal purposes to ensure athlete safety and will remain confidential.

Illness & Exposure Policy
Participants who are experiencing symptoms of illness—including fever, cough, or shortness of breath—or who have been recently exposed to COVID-19 should not attend training sessions until appropriate health guidelines have been followed.

There will be no cancellation fees for missed sessions due to illness or COVID-19-related concerns.

Honesty & Compliance
We rely on the honesty and cooperation of our athletes and families to maintain a safe environment. Any participant or spectator found to be knowingly dishonest regarding symptoms or exposure may be subject to suspension or termination of training services.
